July 9, 2008: Letter from Captain Higgins’s admitting USCG was aware of NH Convictions, RO issued against BM1 Ruggiero and additional information. In this letter Captain Lee makes the statement that the USCG was unaware of the DVP-RO issued against BM1 Ruggiero until March 2008. KR sends Captain Lee a timeline that clearly shows this is a false/inaccurate statement. The date the USCG alleged they were made aware of DVP-RO- Direct is a direct Contradiction to what the USCG informed 4 US Senators and NH Attorney General's Office. Oct 7, 2008: The USCG holds an Administrative Hearing against BM1 Ruggiero. At this time the USCG makes the decision to wait to see the results of BM1 Ruggiero's Nov 17, 2008 Appeals Hearing in Rockingham County Superior Court. Dependent upon the results of this will be the deciding factor on whether the USCG keeps or discharges BM1 Ruggiero. Because of the length of prison time Ruggiero received in June 2008 is one of the deciding factors on keeping BM1 Ruggiero in or not. Note it is not the conviction itself; it is the length of prison time that is the deciding factor.

Oct 16, 2008: Jeffrey called Kristin Ruggiero multiple times and threatened to pour acid on her face because she was so vain, disfigure her, kill Brendan and steal Meghan from Kristin. Kristin reported it to Yarmouth, MA Police Department. To date this arrest warrant is still active

BM1 Ruggiero was given a government credit card with a 70, 000 limit when the member had a credit score of 500, 1 filed bankruptcy and 3 current repossessions of vehicles. Please note 2007-2008 USCG again paid BM1 Ruggiero's tuition to Ashford University (Major studied- Psychology)
Note: June 2007-March 2009, BM1 Ruggiero has had a uniform Court Order for Child Support Issued against him. The USCG has only garnished two of BM1 Ruggiero’s paycheck. They continue to use the “Accounting Error” Excuse.

The Domestic Violence Offender Gun Ban ("Gun Ban for Individuals Convicted of a Misdemeanor Crime of Domestic Violence", Pub .L. 104-208, 18 U.S.C. § 922(g)(9)) was an amendment to the Omnibus Consolidated Appropriations Act of 1997 enacted by the 104th United States Congress in 1996. The act is often referred to as "the Lautenberg Amendment" after its sponsor, Senator Frank Lautenberg. The act bans shipment, transport, ownership and use of guns or ammunition by individuals convicted of misdemeanor or felony domestic violence, or who is under a restraining (protection) order for domestic abuse.

“In general terms, the Lautenberg Amendment (18 USC § 922) bars a person convicted of misdemeanor domestic violence from possessing a firearm or ammunition. The ban applies for the convict's lifetime. There is no military or law enforcement exception, which means that a Coast Guard member who is convicted should not have access to firearms”. “The amendment also prohibits the possession of firearms by persons who have an active restraining order against them as a result of a domestic violence incident, even though they have not been convicted. Unlike the lifetime ban, the prohibition based on a restraining order ends with the restraining order”. “Upon notification the Command removes the member from any position that requires or has access to firearms. A full explanation of Coast Guard policies regarding the Lautenberg Amendment can be found in the Ordnance Manual, Commandant Instruction M8000.2D, and the Personnel Security Program Manual, Commandant Instruction M5520.12C” ‘The Privacy Act is not optional and it carries criminal penalties if violated. It is a shield that protects the individual, not the agency, from invasion of privacy. Because the Coast Guard follows the law, we protect privacy even when that means refraining from effectively rebutting erroneous information in the public domain’. ‘We are reviewing ways of using employee certification that they comply with the amendment when qualifying with weapons to better ensure no violations take place with government firearms’.
